MINI-SESSION AGREEMENT
PORTRAIT SESSION: Client is guaranteed up to 15 minutes of shooting time. When proofs are ready photographer will put up the proofs to view and client can choose the 10 photos they would like retouched. There is an option to purchase additional photos when selecting photos to be retouched. Photographer does not give out raw files. Photographer does not supply outfits for the sessions. This session does not include Santa. Santa Experience with this drop is a whole different session.
Client agrees to the $50 non-refundable deposit/non-transferable and all sales of the session are final.
Photos are retouched however it is an additional cost for face swaps or cleaning of shoes. Those can be very time consuming so Jacquelyn Kolosow Photography has to charge additional for the extra time put in.
CANCELLATION/POSTPONEMENT/NO SHOWS: Sessions are non-refundable & deposits are non-transferable. Client agrees and acknowledges that the date/time they choose the deposit is ONLY good for that date/time. If you need to cancel or want to reschedule you will need to book a new session because the deposit only reserves that date/time. The deposit reserves the date/time so no one else can reserve that time so deposits are non-refundable (cannot be transferred to a different time.)
WEATHER: If sessions are canceled due to weather, Photographer and Client will reschedule at the earliest date possible, with no additional charge.
COOPERATION: Client will arrive 10 minutes early due to short shooting window. IF YOU ARE LATE THERE WILL BE A LATE FEE OF $50 added to your session balance. Please configure chance of traffic into your time of travel to the studio for the session. Only a grace period of 5 minutes & then after 5 minutes a $50 late fee automatically gets added to your remaining session balance. Sessions will be back to back so lateness can not happen. Please be respectful of other people's time and make sure to show up on time. Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions. Photographer is not responsible if a child or adult falls during the session. Remaining balance is still due if child doesn't cooperate. If you believe your child might not cooperate it is recommended to book another session for more time. Screenshots of proofs is a breach of contract. Proofs are not allowed to be screenshot/saved. You have to purchase any additional photos you would like from the session. Photographer does not and will not give the raw files, those are the property of Jacquelyn Kolosow Photography.
Client agrees the $50 payment is only for the date/time booked on the contract. If you are unable to make it to the session you forfeit the deposit.
Sessions will not go over 15 minutes.
Proofs are up for one week If proofs are not chosen after one weeks photo will be removed from site and client will have to pay a $25 re-add fee to have access to them again. When the retouched photos are ready, photos will be kept on the client viewing site for one month to be downloaded. If failure to download retouched photos within a month, a $25 re-add fee will be charge to have access to them again.
COPYRIGHT: All images are copyrighted to and remain the property of Jacquelyn Kolosow Photography. Client agrees to not taking screenshots of proof photos. Proofs are the property of Jacquelyn Kolosow Photography. ONLY the photographer has the rights to edit the photos. Client or any other photographer does not have the rights to edit a photo after receiving the retouched photos. That is breach of contract. Clients are not allowed to alter the photos such as changing the colors of the photo. Jacquelyn Kolosow Photography takes the time to ensure the colors are accurate. If you want really close up photos you must state during the session. Close cropping a photo on own destroys my work. If you would like a photo in black and white please state in messages. I do special type of black and whites so adding it yourself is destroying my work.
Client agrees that the photographer is allowed to post the photos on social media/use for advertising and her website. If I disagree to this then session is no longer discounted and will be charged full price for the session. The point of doing this session is to use as promo photos.
CLIENT’S USAGE: Client has the right to print through their print company in any size. However, Jacquelyn Kolosow Photography is not responsible for poor image quality printed at a company of the clients choice. Client can choose to go through Jacquelyn Kolosow Photography for high quality prints. Jacquelyn Kolosow Photography does not have any recommendations on where to get prints made besides through her. Photographer can guarantee the print quality if you go through her to get prints made.
When posting the photographs on social media you MUST credit Jacquelyn Kolosow Photography.
CELL PHONE POLICY/PHOTO/VIDEO POLICY: ONLY THE PHOTOGRAPHER IS ALLOWED TO TAKE THE PHOTOS. You are not allowed to take photos or video on any type of device. Please be respectful to the photographer. You are paying for her to take the photos so no one else is allowed to.
PAYMENT CHOICES: Credit (there is a 3% convenience fee on card transactions), Cash, Venmo, Cash App, Apple Pay, or Zelle. (Please note if you pay in cash photographer will not have change on her to break bills.)
