MINI-SESSION AGREEMENT
PORTRAIT SESSION: Client is guaranteed up to the shooting time for the package they selected. When proofs are ready photographer will put up the proofs to view and client can choose the photos they would like retouched. Photographer will be emailing the proofs not through Facebook messenger. So please ensure the email you give is correct. When the photos are ready to download photographer will be emailing the link and password. There is an option to purchase additional photos when selecting photos to be retouched. Photographer does not supply outfits for the sessions. Client acknowledges that all sales of the session is final. There are no refunds. Once a package has been selected it cannot be upgraded when viewing proofs.
Photographer does not give out raw files. Client will only get the retouched photos when ready for download, not any proof photos. Client agrees that they will not screenshot (that means no saving to your phone or computer.) All photos are the property of the photographer and the client does not have rights to save the proofs. All photos are numbered so if you have a question about a photo you would give me the number of the photo. Screenshooting or saving proofs are a breach of contract.
**Client agrees to the non-refundable deposit/non-transferable and all sales of the session are final.**
It is an additional cost for face swaps, removing of marker/pen on skin, removing wrinkles, fixing of hair, fixing nail polish, removing of objects, or cleaning of shoes. Those can be very time consuming so Jacquelyn Kolosow Photography has to charge additional for the extra time put in.
CANCELLATION/POSTPONEMENT/NO SHOWS: Sessions are non-refundable & deposits are non-transferable. Client agrees and acknowledges that the date/time they choose the deposit is ONLY good for that date/time. If you need to cancel you will forfeit the deposit. If you want to reschedule you will need to book a new session because the deposit only reserves that date/time in the contract.
WEATHER: If sessions are canceled due to weather, Photographer and Client will reschedule at the earliest date possible, with no additional charge. The rain date will be June 28th for June 27th sessions and rain date is July 19th for July 18th sessions. If it is cloudy and no sun the SESSIONS WILL STILL HAPPEN. Cloudy is one of the best kind of days you could ask for and photographer will not reschedule unless it's raining.
COOPERATION: Client will arrive 10 minutes early due to short shooting window. IF YOU ARE LATE THERE WILL BE A LATE FEE OF $25 added to your session balance. Please configure chance of traffic into your time of travel to the studio for the session. Only a grace period of 5 minutes & then after 5 minutes a $25 late fee automatically gets added to your remaining session balance. Photographer does book sessions back to back so photographer cannot allow more than a 5 minute grace period. Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions. Photographer is not responsible if a child or adult falls during the session. Remaining balance is still due if child doesn't cooperate. If you believe your child might not cooperate it is recommended to book another session for more time. If you do an add on of an additional drop and we don't get to use it cause of child cooperation a balance for the add on is still due for the time spent setting up the drop.
If client arrives really early photographer will most likely not be able to take client before scheduled time. Photographer does book other sessions that day so photographer could have sessions before client's scheduled time. At most photographer might be able to take client 15 minutes early. If photographer is able to that does not give your session extended time.
Client agrees the $75 deposit is only for the date/time booked on the contract. If you are unable to make it to the session you forfeit the deposit. Non-transferable deposit means deposit cannot be transferred. There is NO rescheduling allowed. If you need to reschedule you will need to pay a new deposit. The deposit is only good for what you have selected on this contract. So please make sure you are able to do the date/time you have chosen.
If you need to change that does count towards your time of the session. If you come really early photographer will not be taking you until your scheduled appointment. Photographer does book back to back sessions. The door will be locked until photographer is ready for your session. There will be a sign on the door that says photographer is currently in session.
Proofs are up for two weeks. If proofs are not chosen after two weeks photos will be removed from site and client will have to pay a $25 re-add fee to have access to them again. When the retouched photos are ready, photos will be kept on the client viewing site for one month to be downloaded. If failure to download retouched photos within a month, a $25 re-add fee will be charge to have access to them again.
Sessions will not go over the time frame. If photographer doesn't have a session right afterwards the session can continue for additional cost. $25 per additional 15 minutes. It is not fair to the photographer to work for free for additional time spent on the session.
CELL PHONE POLICY: NO taking photos or video with cell phones or other devices during the session. Only the photographer is allowed to take photos during the session.
COPYRIGHT: All images are copyrighted to and remain the property of Jacquelyn Kolosow Photography. Client agrees to not taking screenshots of proof photos. Proofs are the property of Jacquelyn Kolosow Photography. Clients are not allowed to alter the photos for example changing the colors of the photo. Jacquelyn Kolosow Photography takes the time to ensure the colors are accurate. Only Jacquelyn Kolosow Photography has the right to edit the photos. Putting snapchat/instragram filters is NOT allowed. That is a breach of contract because you are editing/altering the photos. If you want really close up photos you must state during the session. Close cropping a photo on own destroys my work. If you would like a photo in black and white please state in messages. I do special type of black and whites so adding it yourself is destroying my work.
Client agrees that the photographer is allowed to post the photos on social media and her website.
CLIENT’S USAGE: Client has the right to print through their print company in any size. However, Jacquelyn Kolosow Photography is not responsible for poor image quality printed at a company of the clients choice. Client can choose to go through Jacquelyn Kolosow Photography for high quality prints. Jacquelyn Kolosow Photography does not have any recommendations on where to get prints made besides through her. Photographer can guarantee the print quality if you go through her to get prints made.
When posting the photographs on social media you MUST credit Jacquelyn Kolosow Photography.
PAYMENT CHOICES DAY OF SESSION: Credit (there is a 3% convenience fee on card transactions), Cash, Venmo, Cash App, Apple Pay, or Zelle. (Please note if you pay in cash photographer will not have change on her to break bills.)
